The website www.hoveerent.com and the mobile application ‘hovee Rent’ are owned and operated by Shersi Communication Private Limited, a company incorporated under the laws of India. We are engaged in facilitating tenants and property owners to explore and discover various types of properties—including buildings, houses, flats, and other residential or commercial units—and to conduct rental transactions securely and efficiently.

These Terms and Conditions (“Terms”) govern your use of the rental property platform (“Platform”) offered by hovee Rent under Shersi Communication (“we,” “our,” or “us”). This document, together with our Privacy Policy, constitutes an electronic record under the Information Technology Act, 2000, along with applicable rules and amendments. This record is generated by a computer system and does not require physical or digital signatures.

Please read these Terms carefully before using our services. By accessing or using hovee Rent, you agree to be bound by these Terms. If you do not agree, please refrain from using our services.

Definitions :

1)Agreement : A formal arrangement between two or more parties outlining their rights and responsibilities.

2) As Is : The user agrees to accept the property in its current condition without objection or request for alteration.

3)Applicable Law : Refers to all relevant laws, regulations, and rules that apply to a property or transaction.

4)Information Technology Act, 2000 : The primary Indian law regulating cybercrime and e-commerce. It provides legal recognition for electronic transactions, supports e-governance, and outlines penalties for digital offenses.

5)Intellectual Property Rights (IPR) : Legal rights granted to creators, inventors, or owners of intellectual property to protect and control their innovations. IPR includes:

1. Copyrights : Protection of original creative works (e.g., text, images, software).

2. Patents : Exclusive rights granted for a new invention or innovation.

3. Trademarks : Protection of brand names, logos, and identifiers.

4. Trade Secrets : Confidential business information or methods that offer a competitive advantage.

6) Services – Refers to all offerings provided by hovee Rent within India, including :

(a) Connecting tenants and property owners without brokerage.

(b) Allowing users to list their properties for rent.

(d) Assistance with rental paperwork, such as lease agreements, police verification, registration, and society approvals

(e) Advertising services for products and listings

(f) Sending promotional offers and updates via email or SMS.

(g) Enabling community-based features for residents (building-specific networking)

(h) Providing rental payment solutions via third-party payment gateways

(i) Connecting users to third-party service providers for other value-added services

7) Website Refers to the official website www.hoveerent.com and the hovee Rent mobile application, both owned, operated, and managed by Shersi Communication Private Limited.

8) Third Party Service Provider Any external service provider with whom hovee Rent has an agreement to offer additional services to users beyond what is directly available on the platform.

9) User Any individual who has agreed to the platform’s terms and conditions, typically by registering an account or otherwise accepting the platform's terms of use.

10) User Information Includes all data provided by the user to hovee Rent, such as registration details, personal information, and any other communication (via website, email, or other channels), in relation to the platform's services.

Platform Use and Registration

1.1. Eligibility: To use the platform, you must be at least 18 years old and legally capable of entering into a binding contract. If you are under 18, please refrain from accessing or using the platform or submitting any personal data.

1.2. Registration: To access certain services, you must create an account by completing our registration form with accurate and complete information. You agree to maintain and update this information as needed. By registering, you authorize us to disclose relevant registration data to trusted third parties, as outlined in our Privacy Policy. Continued use of the platform implies agreement with this policy.

1.3. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account. If you suspect unauthorized use or breach of your account, notify us immediately. Prompt action is necessary to secure your data and prevent further misuse.

Listing and Rental Process

2.1. Listing: By listing a property, you confirm that you have the legal right to offer it for rent and that all information provided is accurate, complete, and not misleading. You agree to comply with all relevant laws, including those related to fair housing and advertising. We reserve the right to edit, remove, or suspend listings or accounts that violate these terms or our platform policies, at our sole discretion.

2.2 Verification : The verification process requires the submission of certain personal details from both owners and tenants. All personal information provided will be handled with the highest level of confidentiality and in strict compliance with applicable data protection laws. Should the verification status of either a tenant or an owner be found invalid at any point, their access to personal information will be suspended until successful re-verification. Submission of false or misleading information during the verification process may result in suspension or termination of platform access for the respective user. Verified details will only be accessible to tenants and owners after mutual verification has been completed.

2.3 Enrollment : Tenants seeking to rent properties listed on the platform must accept and adhere to the terms and conditions of hovee Rent. These terms establish the rules and guidelines governing the use of the platform to book accommodations. By proceeding with a rental, tenants confirm their understanding and acceptance of these provisions, ensuring clear recognition of the rights and responsibilities of both owners and tenants prior to the rental period.

2.4 Ratings : Our rating system facilitates valuable feedback, fosters trust between owners and tenants, and supports continuous improvement of the hovee Rent platform. Users are required to submit ratings at the end of each quarter (1st, 2nd, 3rd, and 4th quarters). Notifications prompting rating submissions will be sent via pop-ups and email reminders. Once submitted, ratings are final and cannot be modified or updated. Failure to submit a rating within the specified period will result in the temporary freezing of the user’s account until the next rating is submitted.

2.5 Subscription Plans : hovee Rent offers three annual subscription tiers: Basic, Plus, and Premium.

(a) Basic: This introductory tier provides limited functionality, including restricted access to verified listings and basic search filters. The subscription is valid for one year.

(b) Plus: Offers enhanced features such as one-to-one chat, higher listing priority and the ability for owners to verify more listings. Tenants gain early access to new listings and can bookmark favorites. The subscription is valid for two years.

(c) Premium: Provides owners with unlimited property verifications and the highest listing visibility. Tenants receive personalized recommendations, rental reminders, alerts, and direct chat capabilities with owners (with defined chat categories). All “Plus” features are included. The subscription is valid for three years.

Users may select a subscription plan that best suits their preferences and rental needs.

Payments and Fees

3.1. Payments: Payments for bookings are processed exclusively through the hovee Rent platform. Both owners and tenants agree to comply with the payment terms outlined in our Payment Policy. Users must provide accurate, current, and complete payment information and are responsible for keeping this information up to date. hovee Rent shall not be liable for any losses resulting from inaccurate or incomplete payment information provided by users.

3.2 Refunds : If hovee Rent is unable to transfer the rent amount to the beneficiary’s account due to technical issues, a refund will be issued to the original payment source. Refunds will be processed within 15 working days, subject to bank processing times.

3.3. Fees: Certain services on the platform may incur fees, which will be clearly disclosed prior to the user incurring any charges. Users acknowledge and agree that hovee Rent may charge service fees for facilitating rental payments or security deposit transactions through the platform.

Content and Conduct

4.1. User Content : Users are solely responsible for all content they post on hovee Rent, including property listings, reviews, messages, and any other shared or uploaded materials. Users must ensure that all information, images, and materials are accurate, truthful, and comply with hovee Rent’s terms and conditions, as well as all applicable laws and regulations. Users should regularly review their content to ensure ongoing compliance with platform standards and to accurately reflect their intentions.

4.2. Prohibited Conduct : You agree not to engage in any conduct that violates these Terms, including but not limited to fraud, harassment, or misuse of hovee Rent. Users must use the platform for lawful purposes only. Posting or transmitting any material that infringes the rights of others, is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, or otherwise objectionable is strictly prohibited. This includes content that encourages criminal activity, civil liability, or violates any law.

Any user conduct that, in hovee Rent’s sole discretion, restricts or inhibits other users from enjoying the platform is forbidden. Users shall not use hovee Rent for advertising or commercial solicitation, including encouraging users to subscribe to competing services. Prohibited activities include defamation, abuse, harassment, stalking, threats, or violation of legal rights; posting unlawful or inappropriate content; infringing intellectual property rights; and uploading files containing viruses or harmful code.

Privacy

5.1. Data Collection : We collect and use your personal information as detailed in our Privacy Policy. By using hovee Rent, you acknowledge that the Privacy Policy governs your use of the platform alongside these Terms. Continued use of hovee Rent constitutes acceptance of the Privacy Policy and agreement to its terms.

Intellectual Property

6.1. Ownership: All intellectual property rights related to hovee Rent and its content—including text, graphics, images, software, and trademarks—are owned by us or our licensors and protected by applicable laws. You may not use or reproduce any content from hovee Rent without prior written consent.

6.2. License: We grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use hovee Rent for its intended purpose. All rights not expressly granted remain with hovee Rent and its affiliates.

Disclaimer of Warranties

7.1. As Is : hovee Rent is provided on an "As Is" and "As Available" basis. We make no warranties regarding the accuracy or completeness of content on the platform or linked third-party websites.

Limitation of Liability

8.1. Exclusion : To the fullest extent permitted by law, hovee Rent shall not be liable for any indirect, incidental, special, consequential, punitive damages, or loss of profits or revenues, whether direct or indirect.

Indemnification

9.1. Defense : You agree to defend, indemnify, and hold harmless hovee Rent and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the platform or violation of these Terms.

Termination

10.1. Termination : hovee Rent may suspend or terminate your access at any time, with or without cause or notice. Fraudulent, abusive, or illegal activity may lead to immediate account deactivation and referral to law enforcement. Upon termination, all your account data and access will be removed.

Governing Law and Dispute Resolution

11.1. Jurisdiction and Disputes : These Terms are governed by the laws of India. Any disputes arising from these Terms or the platform will be subject to the exclusive jurisdiction of the courts in Chennai. Arbitration proceedings will be conducted in Tamil.

Miscellaneous

12.1. Entire Agreement : These Terms, together with any operating rules established by hovee Rent, constitute the entire agreement between you and hovee Rent regarding your use of the platform and supersede all prior agreements. If any provision is found invalid or unenforceable, the remaining provisions will remain effective.

General : By using hovee Rent, you agree that these Terms and Conditions form the complete and exclusive agreement between you and hovee Rent, superseding any prior communications. hovee Rent reserves the right to modify these Terms at any time by posting updates on the platform. Changes take effect immediately upon posting. Continued use of the platform after changes indicates your acceptance of the updated Terms. hovee Rent may terminate any user rights under these Terms with or without notice.
